The Constitution of the Republic of South Africa, 1996 makes provision for an accused’s right to apply for bail. The accused person can apply at any stage of the court proceedings for bail when he or she is before court. The accused person must be brought before court within 48 hours of being arrested if bail has not been granted by the prosecutor or police.
